Terms and Conditions of PakaKumi
General
1.1. These Terms and Conditions (T&C) form an agreement between Reys and Meys Limited (the Company) and you, the Player.
1.2. These T & Cs govern your use of the pakakumi.com website (referred to as PAKAKUMI, PakaKumi, or the Website).
1.3. By clicking ‘I Accept Terms And Conditions’ and registering, you acknowledge that you have read and accepted these T&C and confirm that you are at least 18 years old. Using any part of the Website after logging in indicates your agreement to these T&C.
1.4. You must read these T&C before registering and clicking the ‘I Accept Terms And Conditions’ checkbox. If you do not agree with these T&C at any time, you are prohibited from using Pakakumi.
1.5. You understand and agree that Pakakumi may modify or amend these T&C at any time.
2. Eligibility to Use Pakakumi
2.1. You may use Pakakumi only if:
2.2. You are at least 18 years old or have reached the minimum legal age as required in your jurisdiction; and
2.3. It is legal for you to use Pakakumi according to the laws in your place of residence.
2.4. It is your responsibility to ensure that you do not violate any laws by using Pakakumi.
2.5. Residents of the following countries are not permitted to use Pakakumi: Australia, USA, Aruba, Bonaire, Belize, Curaçao, Netherlands, France, Saba, St Martin, and Statia.
3. Registration and Information of Your Pakakumi Account
3.1.1 Open an account to start placing bets and making deposits and withdrawals.
3.1.2. All required information must be entered truthfully during registration, including a valid and functioning email/phone number where you can be reached. Providing an invalid phone/email address will prevent you from resetting your password or withdrawing any funds. This applies even if you register through Google, Facebook, or any other third-party login/authentication service. It is your responsibility to ensure that the information provided at registration is accurate, correct, and complete.
3.1.3. During registration, you will choose your phone/email and password. It is your responsibility to keep your login details confidential. Pakakume is not responsible for your account if you have disclosed your login details to a third party whether accidental or intentional passive or active.
3.1.4. Pakakumi reserves the right to refuse registration or close your account. In such cases, all virtual funds (minus transaction fees) in your account will be returned to you.
3. Account Management
3.2. Closing of Account
3.2.1. You can close your account by emailing [email protected]. Pakakumi will refund your account balance, minus any withdrawal fees, using a method of their choice.
3.2.2. Pakakumi reserves the right to close your account and refund the account balance, minus withdrawal fees, at any time and without providing a reason.
3.3. Deposits Into Your Account
3.3.1. Pakakumi may credit a player’s account with a ‘bonus’. The conditions for bonuses are detailed on the bonus page from time to time.
3.3.2. Deposits into your account are made by transferring money from the mobile number associated with your account (and ONLY from that number) to the PakaKumi Paybill Number.
3.3.3. Deposited amounts are available in your account as soon as the payment is confirmed by MPESA.
3.3.4. We may implement procedures to confirm your identity before deposits are credited to your account.
3.3.5. If requested, you must provide genuine documents to us. Any fake or misleading documents may result in the closure of your account and the return of unused deposited funds.
3.4. Withdrawals From Your Account
3.4.1. If your account is mistakenly credited with winnings, the amount will be subtracted from your account. If the balance was already withdrawn before the error was noticed, you owe the amount to us. If your account is erroneously credited, you must inform us immediately by emailing [email protected].
3.4.2. Pakakumi may conduct random verification procedures before processing payouts. This verification may include asking for photocopies of a player’s ID, passport, and requiring the customer to sign a message for an address from which an earlier deposit was made.
3.4.3. Withdrawals are made by directly transferring money via MPESA to the mobile number associated with your account (and ONLY to that number).
4. Your Obligations
4.1. By using Pakakumi, you confirm that:
4.1.1. You are using Pakakumi on your own behalf with your sole Pakakumi account;
4.1.2. You are at least 18 years old or meet the higher minimum age requirement of your jurisdiction;
4.1.3. You are using Pakakumi for personal enjoyment, not professionally;
4.1.4. You understand that using Pakakumi carries the risk of losing the money you deposit;
4.1.5. You acknowledge that currency exchange rates fluctuate, affecting your account’s EUR balance accordingly;
4.1.6. You are responsible for declaring any applicable taxes on your Pakakumi winnings.
4.2. Offensive or obscene messages in Pakakumi’s chat system or in your account name are prohibited.
4.3. If a bet is settled or a payment made by Pakakumi in error, Pakakumi reserves the right to retroactively cancel or correct bets by re-settling them at the correct terms.
4.4. If you notice errors in Pakakumi, you agree not to exploit them and to report them immediately to Pakakumi support. We usually reward such reports. Failing to report errors may result in compensation claims for related costs.
4.5. If a game round starts but later fails, Pakakumi will refund the bet amount to your account.
4.6. Pakakumi may limit or reject wagers. You are not allowed to bet more than your account balance. Winnings are credited to your personal account.
4.7. Pakakumi reserves the right to retain deposits if there is a reasonable suspicion of system manipulation.
4.8. Additional verification may be required if we suspect fraudulent transactions.
4.9. Pakakumi reserves the right to void any wager if:
4.9.1. You or associates are avoiding Pakakumi’s rules;
4.9.2. You or associates may influence the event outcome for an unlawful advantage;
4.9.3. Bets were placed during technical issues at Pakakumi;
4.9.4. Wagers were accepted due to any error, including mistakes, typos, force majeure, or technical issues.
5. Complaints
5.1. Complaints should be directed to our support team via email at [email protected].
5.2. For wager disputes, you agree that server logs are the final authority in determining claim validity.
5.3. If there’s a discrepancy between the result on your screen and the game server logs, the game server results prevail. Server records are the final authority for any wager’s outcome.
5.4. We will contact you regarding disputes using the phone/email provided.
6. Your Account
6.1. You are allowed only one account. Opening multiple accounts may result in blocking or suspension, with any balances frozen.
6.2. If you discover multiple accounts, you must notify us immediately at [email protected]. Failure to do so may result in account blocking.
6.3. Inform us at [email protected] as soon as you notice errors in your account regarding bets. We may rollback any bets affected by such errors.
6.4. A valid email address and all mandatory registration fields are required. Invalid email addresses will prevent withdrawals and password recovery. Ensure all registration information is correct, true, and complete.
6.5. We may conduct Know Your Customer (KYC) procedures, and your account may be temporarily closed or blocked if misleading or false information is supplied.
6.6. During registration, choose a phone/email, username, and password for your account. The username must not be offensive or disruptive. Keep your login details secure and confidential. Pakakumi is not responsible for any misuse of your account due to disclosure.
7. General Wagering Rules
7.1. Bets can only be placed via the internet.
7.2. Bets can only be placed by registered and logged-in account holders.
7.3. Bets can only be placed if your account has sufficient funds.
7.4. Bets are subject to the T&Cs available at the time the bet was accepted.
7.5. Pakakumi may adjust payouts if it is later found that an error occurred.
7.6. Once a bet is accepted, it cannot be withdrawn, changed, or canceled by the player.
7.7. You can view the list and status of your bets on the Pakakumi website.
7.8. By placing a bet, you confirm you have read and understood all T&Cs.
7.9. Pakakumi manages your account, calculates balances, winnings, and bets. Unless proven otherwise, these calculations are final.
7.10. You are solely responsible for all bets placed via your account.
7.11. Winnings are credited to your account once a game round’s final result is confirmed.
7.12. The maximum cumulative payout per game round to all players is KES 1,000,000. Pakakumi reserves the right to cash out players early to avoid exceeding this limit.
8. Canceled and Erroneous Game Rounds
8.1. Pakakumi is not liable for lag, server disruptions, downtime, or any technical issues. Refunds may be given at the discretion of Pakakumi management.
8.2. Pakakumi is not responsible for damages or losses related to interruptions, delays, data corruption, misuse, communication failures, or website content errors.
8.3. If a system malfunction occurs, all bets and bonuses are void.
9. Promotions and Bonuses
9.1. Pakakumi may cancel any bonus or promotion if it believes the bonus is being abused or incorrectly set up. If the bonus has been credited, Pakakumi may decline withdrawal requests and deduct the bonus amount from your balance.
9.2. Pakakumi offers are for recreational players only, and eligibility for promotions may be limited.
9.3. If promotion or bonus terms are breached, or if there is a pattern of deposits or bets that result in guaranteed profits, Pakakumi may reclaim the bonus, void bets funded by the bonus, or void the bonus itself. Pakakumi may charge your account to cover administrative costs and may require documentation to verify identity before issuing any bonus.
9.4. Pakakumi reserves the right to amend, reclaim, refuse, or cancel any promotion at its discretion.
9.5. Separate T&Cs may apply to special offers, promotions, and bonuses, and these will take precedence in case of discrepancies with the general T&Cs.
9.6. Bonuses are limited to one per person, account, household, family, email address, address, and IP address. Pakakumi may close your account and return deposits if evidence of abuse or fraud is found.
9.7. Promotions and bonuses may have withdrawal restrictions and additional requirements. These terms will be published with the promotion. Withdrawing before meeting wagering requirements will result in the deduction of the full bonus amount and any winnings from your account.
